Terms

Introduction

These Terms govern the use of the PHPARK Website and the PHPARK Service. They constitute a binding legal agreement between you, the customer, and PHPARK. By accessing the PHPARK Website or using the PHPARK Service, you acknowledge and agree to these Terms and any amendments published from time to time. If you do not accept these Terms, you must refrain from using the PHPARK Service.

PHPARK is operated by an licensed gaming operator. The Service includes betting, gaming, and related services made available through the PHPARK Platform. These Terms apply to all users whether you access as a guest or as a registered account holder.

General Terms

We reserve the right to revise and amend these Terms at any time. Amendments become effective immediately upon publication on the PHPARK Website. If you object to any changes, you must immediately stop using the Service. Any bets settled prior to the changes will remain governed by the Terms in effect at the time the bet was placed.

Your Obligations

1. 3.1 You are at least 18 years old or the legal gambling age applicable in your jurisdiction. PHPARK may request proof of age documents at any time.
2. 3.2 You have the legal capacity to enter into a binding agreement with PHPARK. You must not access the Service if you lack such capacity.
3. 3.3 You are resident in a jurisdiction where online gambling is lawful for you. It is your sole responsibility to ensure that use of the Service complies with the laws of your place of residence.
4. 3.4 You shall not use a virtual private network, proxy, or other tools that mask or manipulate your real location.
5. 3.5 You are the authorized user of the payment method used to fund your PHPARK account.
6. 3.6 You must process all payments in good faith and not take actions intended to reverse or cause reversal of a payment by a third party.
7. 3.7 You acknowledge that you may lose some or all funds deposited in the PHPARK Service in accordance with these Terms and you are fully responsible for any such loss.
8. 3.8 You shall not rely on information obtained through the Service that is illegal or obtained in breach of any applicable law.
9. 3.9 You act solely as a private individual and not on behalf of a third party or for commercial purposes.
10. 3.10 You must not manipulate any aspect of the Service in bad faith or in a manner that would compromise its integrity.
11. 3.11 You must act in good faith in relation to PHPARK and the Service at all times in respect of all bets and transactions.
12. 3.12 You and any related entities are not registered as an Affiliate in PHPARKs Affiliate program unless expressly authorized.

Restricted Use

1. 4.1 You must not use the Service if you are under the applicable age, not legally able to enter into a binding agreement, or otherwise prohibited from accessing online gambling.
2. 4.2 You may not reside in a jurisdiction that prohibits access to online gambling for its residents or for any person within such jurisdiction.
3. 4.3 You may not access the PHPARK Service from certain restricted countries or territories as determined by PHPARK from time to time.
4. 4.4 You shall not collect nicknames, email addresses, or other information of other customers through the Service by means such as spam or unsolicited messages.
5. 4.5 You shall not disrupt or unduly affect the operation of the Service or other customers use of the Service.
6. 4.6 You shall not promote unsolicited commercial advertising or affiliate links within the Service.
7. 4.7 You shall not engage in any activity that could exploit the Service or a fellow customer or enable collusion to obtain an unfair advantage.
8. 4.8 You shall not scrape PHPARKs odds or infringe PHPARKs intellectual property rights.
9. 4.9 You shall not use the Service for any unlawful activity.
10. 4.10 You may not sell or transfer your PHPARK account to a third party, nor acquire a PHPARK account from a third party.
11. 4.11 You may not transfer funds between customer accounts.
12. 4.12 PHPARK may terminate your account immediately for unauthorized use and may pursue legal action where appropriate.
13. 4.13 Employees of PHPARK and associated entities, or their close family members, may be restricted from real money use without explicit consent from a designated officer, and violations may result in immediate account termination and forfeiture of bonuses or winnings.

Registration

1. 5.1 PHPARK may refuse to register an applicant at its sole discretion without the obligation to provide a reason.
2. 5.2 Before using the Service or withdrawing winnings, you may be required to complete the registration process and become a verified Customer. Verification may include providing valid identification and documents such as a government issued ID and a recent utility bill showing your name and address. PHPARK may suspend wagering or restrict account options until the required information is received, in compliance with applicable gaming regulations and anti money laundering requirements. You must also fund your PHPARK account using the payment methods listed in the Service.

Your Account

1. 6.1 Accounts may be held in multiple currencies; balances and transactions appear in the currency used for the relevant transaction.
2. 6.2 PHPARK does not extend credit through the Service.
3. 6.3 PHPARK may close or suspend an account if you fail to comply with these Terms or to maintain the integrity or fairness of the Service. Prior notice may not always be possible. If an account is closed or suspended for non compliance, PHPARK may cancel or void any bets and withhold funds in the account including the deposit.

Inactive Accounts

1. 7.1 If the PHPARK account remains with a positive balance and there has been no login, no Service use, and no bet activity for twelve consecutive months, an Inactive Account Fee of 5 EUR or currency equivalent may be charged per calendar month.
2. 7.2 PHPARK will notify the customer as the inactivity fee is about to commence and the customer retains the option to log in and withdraw funds.
3. 7.3 The Inactive Account Fee is withdrawn monthly to the extent the account remains credit and only for the period of inactivity after the initial twelve month period. If the balance is less than 5 EUR, the fee may be collected as the remaining balance.

Payment Transactions and Processors

1. 8.1 You are responsible for paying all amounts due to PHPARK. Payments must be made in good faith and you may not reverse a payment or facilitate third party reversal to avoid liability. You will reimburse PHPARK for any chargebacks, denials, or reversals and any losses arising therefrom. PHPARK may impose an administration fee of 50 EUR (or currency equivalent) for each chargeback, denial, or reversal.

Errors

1. 9.1 In the event of a system error or malfunction, all bets are void. You must inform PHPARK immediately if you become aware of an error. PHPARK is not liable for costs or losses arising from errors, bugs, or viruses and reserves the right to void affected games or bets and take appropriate corrective action.

Rules of Play, Refunds, and Cancellations

1. 10.1 The winner of an event is determined on the date of settlement. Protested or overturned decisions will not be recognized for wagering purposes once settled.
2. 10.2 All posted results are final after 72 hours. Within 72 hours PHPARK may reset or correct results only for human error, system error, or errors from the referring result source.

Communications and Notices

1. 11.1 Communications from you to PHPARK must be sent via the Customer Support channel available on the PHPARK Website.
2. 11.2 PHPARK will communicate with you by posting on the PHPARK Website or sending to the registered email address on file unless otherwise stated. The method of communication is at PHPARKs sole discretion.

Matter Beyond Our Control

PHPARK will not be liable for any failure or delay in providing the Service due to events outside its control, including force majeure, government actions, network disruptions, or third party failures. In such events, PHPARK reserves the right to cancel or suspend the Service without liability.

Liability

To the extent permitted by law, PHPARK will not compensate for foreseeable loss or damage arising from failures to perform its obligations under these Terms, except where a breach results in death or personal injury. Liability may be limited by factors including your own fault, third party actions outside PHPARK control, or events neither PHPARK nor its suppliers could foresee even with reasonable care. This Service is intended for consumer use; PHPARK will not bear liability for business losses of any kind.

Gambling by Those Under Age

1. 14.1 If PHPARK suspects that you are under the applicable age or you were under age when placing bets, your account will be suspended to prevent further wagering or withdrawals. If underage betting is confirmed, winnings in your account may be retained or paid to PHPARK on demand, and deposits may be returned or retained in PHPARKs discretion. PHPARK reserves the right to deduct transaction fees from any returned funds and to pursue recovery of any sums as permitted by law.
